DECEASED ESTATES:

When someone dies and leaves property only in their name, that property must go through Probate, no matter what the
value is. -
All estates with a total value of $40,000.00 or more, must be handled by an attorney.

Property that is jointly held, TOD, transferred on death, POD, payable on death, has living beneficiaries or is listed under a trust, may not have to go through Probate.
RESPONDENT ESTATES:

A person over 18 that cannot make decisions for themselves, personal or financial, needs a Guardian and/or Conservator.
- All Petitions must be filed by an attorney.
MINOR ESTATES:

A person under 18 whose parents’ cannot take care of them, needs a Guardian and/or the child acquires money that needs to be supervised by the Court, needs a Conservator.
- All minor guardianships and conservatorships where Mom and Dad are not both serving as conservatiors, must be filed by an attorney
LIMITED MINOR GUARDIANSHIP:

A person under 18 that is living with someone other than a natural parent and that person needs to be able to enroll that child in school and/or put them on their medical insurance only, needs a limited guardian. A Limited Guardian has no other rights.
