Issue:
May a judge serve on the Missouri Mental Health Commission?
Discussion:
The Missouri Mental Health Commission serves in an advisory capacity to the Director of the Department of Mental Health. The Director is responsible for planning, organizing, and supervising Missouri’s mental health, mental retardation-developmental disabilities, alcohol and drug abuse activities.
Supreme Court Rule 2, Canon 5G states:
It is the Commission’s opinion that a judge’s service on the Mental Health Commission would involve activity and concern issues of fact and policy on matters which are other than the improvement of the law, the legal system, and the administration of justice. A judge should not, therefore, serve on the Mental Health Commission.

The Missouri Mental Health Commission serves in an advisory capacity to the Director of the Department of Mental Health. The Director is responsible for planning, organizing, and supervising Missouri’s mental health, mental retardation-developmental disabilities, alcohol and drug abuse activities.

A judge should not accept appointment to a governmental committee, commission, or other position that is concerned with issues of fact or policy on matters other than the improvement of law, legal system, or the administration of justice.
It is the Commission’s opinion that a judge’s service on the Mental Health Commission would involve activity and concern issues of fact and policy on matters which are other than the improvement of the law, the legal system, and the administration of justice. A judge should not, therefore, serve on the Mental Health Commission.
