Issue:
Can an Associate Circuit Judge serve as a member of the Selective Service local draft board?
Discussion:
Supreme Court Rule 2, Canon 4C states:
The question is, therefore, whether the function of the Selective Service Board is to improve the law, the legal system or the administration of justice. It is the opinion of the Commission on Retirement, Removal and Discipline that the function of the Selective Service Draft Board does not involve the improvement of the law, the legal system, or the administration of justice and, therefore, an Associate Circuit Judge should not serve as a member of his local draft board.

Discussion:
Supreme Court Rule 2, Canon 4C states:
A judge subject to the proper performance of his judicial duties, may engage in the following quasi judicial activities if in doing so he does not cast doubt on his capacity to decide impartially any issue that may come before him:
... (C) he may serve as a member, officer or director of an organization or governmental agency devoted to the improvement of the law, the legal system, or the administration of justice.

The question is, therefore, whether the function of the Selective Service Board is to improve the law, the legal system or the administration of justice. It is the opinion of the Commission on Retirement, Removal and Discipline that the function of the Selective Service Draft Board does not involve the improvement of the law, the legal system, or the administration of justice and, therefore, an Associate Circuit Judge should not serve as a member of his local draft board.
