(This Opinion discusses a prior version of the Canons of Judicial Conduct; the most comparable current rule is 2-3.7 Participation in Educational, Religious, Charitable, Fraternal or Civic Organizations and Activities, Subdivision (A).)
Issue:
May a judge serve on a state committee administered by the Office of Administration pursuant to Section 33.103 RSMo Supp. 1975 that determines the eligibility of organizations requesting permission to participate in the Missouri State Employee Charitable Campaign? As a member of this committee, the judge would not be involved in direct solicitation but would set guidelines and procedures for work place solicitation of government employees by the various charities.
Discussion:
Supreme Court Rule 2, Canon 4C states:
In the opinion of the Commission on Retirement, Removal and Discipline, the above described committee is under the administration of the Office of Administration of the State of Missouri and as such is part of a governmental organization or agency. As a result, the judge should not participate on this committee as the committee’s purpose is not to improve the law, the legal system or the administration of justice.

He may serve as a member, officer, or director of an organization or governmental agency devoted to the improvement of the law, the legal system, or the administration of justice.
