Issue:
May an associate circuit judge attend a real estate arbitration proceeding involving the judge’s spouse who is a real estate broker? Secondly, may the judge confer with the attorney who represents the judge’s spouse and her brokerage firm?
Discussion:
Supreme Court Rule 2, Canon 5F states:
In the opinion of the Commission on Retirement, Removal and Discipline, the judge may attend the arbitration proceedings and may discuss the case with his wife and his wife’s attorney. However, the judge attendance at the hearing should be limited to the role of a spectator. Finally, the judge should not directly or indirectly lend advice or assistance during the hearing.
