Court Operating Rule (COR) 7 | Circuit Court Personnel System

COR 007.01 | Circuit Court Personnel System: Established

The circuit court personnel system is hereby established and shall apply to the employees of the circuit court whose positions are funded by the state of Missouri pursuant to sections 211.393, 476.083, 483.245, 485.010, and 487.060, RSMo.

The system shall be composed of the following designated parts and became effective July 1, 1981, unless otherwise provided herein:

7.01.A | Definitions.

Part A shall include a definition of the terms used within this Rule.

7.01.B | Operating Procedures.

Part B shall include guidelines for the allocation of staff that became effective September 30, 1980, uniform job classes, and the job classification plan that became effective July 1, 1981.

7.01.C | Personnel Policies.

Part C shall include a description of authorized benefits and leave policies not otherwise provided by statute.

7.01.D | Compensation and Pay Plan.

Part D shall include uniform salary ranges and steps within the ranges for each job class, the method by which salaries will be determined and additional provisions as may be necessary relating to the compensation of employees.

7.01.E | Job Descriptions.

Part E shall include the approved job descriptions of the circuit court personnel system. The job descriptions shall include uniform titles, an outline of the duties and responsibilities to be performed, and the desired qualifications for the position.

COR 007.02 | Interim Stabilization Procedure

7.02.1 | Effective Date.

Rule 7.02 shall become effective September 30, 1980 and shall expire on July 1, 1981.

7.02.2 | Salary Computation Date.

The salary of each deputy and division clerk requested in the state budget shall be computed using the standard salary conversion formula contained in section 7.01.D.4 of this Rule and shall be based on the salary paid to the employee as of June 1, 1980 or as approved by the Committee.

7.02.3 | Stabilization of Salaries.

Any salary increase granted to an employee after June 1, 1980 will not be included in the state budget request, except reported merit increases meeting the criteria set forth in the Interim Circuit Court Budget Committee memorandum dated June 20, 1980.

The requested salary for each employee will be adjusted on July 1, 1981 by any cost-of-living increase granted by the General Assembly.

The salary of an employee, which has been increased by an appointing authority above the amount requested and finally appropriated for that employee, shall be reduced on July 1, 1981.

7.02.4 | Stabilization of Number of Employees.

The maximum number of full-time equivalent employees for each circuit to be converted to the state payroll shall be the number included in the FY 81-82 circuit court budget request. Circuits shall not employ additional full-time equivalent employees to be converted to the state payroll without the prior approval of the Circuit Court Budget Committee.

7.02.5 | Stabilization of Standard Work Week.

The standard number of hours worked each week by an employee shall be used to compute the base salary of an employee. The standard work week of an employee shall not be increased without the prior approval of the Circuit Court Budget Committee.

7.02.6 | Stabilization of Job Classes of Employees.

The assignment of job classes to employees for the purpose of this system shall be the sole responsibility of the Circuit Court Budget Committee. Any request to change or modify an assigned job class shall be made in accordance with section 7.01.B.10 of this Rule.

COR 007.03 | Circuit Court Budget Committee: Established

7.03.1 | Effective Date.

There is hereby established as of January 1, 1981 a Circuit Court Budget Committee which will succeed the Interim Circuit Court Budget Committee formed pursuant to Supreme Court Orders of August 28, 1978 and November 13, 1979.

7.03.2 | Membership.

The Committee shall be comprised of 13 circuit and associate circuit judges and one circuit clerk. This Court shall appoint all Committee members.

7.03.3 | Terms of Members First Appointed.

Of the Committee first appointed, four (4) members shall serve from January 1, 1981 through December 31, 1981; four (4) members shall serve from January 1, 1981 through December 31, 1982; and five (5) members shall serve from January 1, 1981 through December 31, 1983.

7.03.4 | Terms of Subsequent Members.

Upon expiration of the terms of the Circuit and Associate Circuit Judges first appointed, the terms of Committee members shall be three (3) years.

7.03.5 | Chairperson.

The Chief Justice shall appoint the chairperson of the Circuit Court Budget Committee from the Committee membership.

7.03.6 | By-Laws.

The Circuit Court Budget Committee may draft and adopt by-laws governing its operation.

7.03.7 | Subcommittees.

The Circuit Court Budget Committee may appoint subcommittees to aid in the operation of the Committee.

COR 007.04 | Circuit Court Budget Committee: Powers and Duties

7.04.1 | Develop Annual Budget Request.

The Circuit Court Budget Committee shall submit recommendations to this Court on or before September first of each year. The recommendations shall include all circuit court salaries and operating expenses authorized by law to be paid by the State of Missouri.

7.04.2 | Administer Personnel System.

The Committee shall have the authority and responsibility to administer the Circuit Court Personnel System herein adopted, as follows:

(a) To allocate state appropriations among the circuits for the funding of the Circuit Court Personnel System; to allocate job classes to appointing authorities; to review and recommend requests for additional personnel; to reclassify positions upon a change in position duties; and to review appeals resulting from actions of the Committee.

(b) To make recommendations to this Court as to changes in the structure of the Circuit Court Personnel System as described in section 7.01 of this Rule. All changes in the structure of the Circuit Court Personnel System require the prior approval of this Court.

(c) To revise any of the individual parts of the Circuit Court Personnel System as those revisions relate to the addition, modification, or elimination of individual job descriptions; the adjustment of staffing guidelines; the amendment of personnel policies; and other necessary revisions provided such revisions do not change the structure of the Circuit Court Personnel System as described in section 7.01 of this Rule.

7.04.3 | Other Duties.

The Committee shall have the authority and responsibility to fulfill other duties as may, from time to time, be assigned by this Court.

COR 007.05 | Request for Information

All judges, clerks, and other court personnel shall comply with requests for information by the Circuit Court Budget Committee in the performance of its duties as set forth in section 7.04 of this Rule.

COR 007.06 | Staff to be Provided

Staff assistance for the Circuit Court Budget Committee shall be provided by the Office of State Courts Administrator.
