Revoking Probation

Offenders placed on probation are required to comply with certain conditions. Offenders accused of violating these conditions are subject to having their probation revoked.

Offenders accused of violating their conditions are entitled to certain due process. They have certain rights if arrested and detained; they also have rights to a preliminary hearing to determine if there is probable cause to believe a violation has occurred. If probable cause is found, then offenders have a right to an evidentiary hearing.
