Civil Forms

Several forms are available for use in various civil legal actions, such as those relating to appeals, executions, garnishments, judgments, SATOP assessments, dissolution (divorce) of marriage, legal separation, modification or paternity cases. NOTE: Court clerks cannot provide assistance in completing these forms.

How to use the forms:

  1. You must save each form before you begin entering information in the form fields. Right click the link for a form and save it to your computer before you begin entering information in the form fields. If you are downloading the form from a public computer, be sure to save the form to a personal device, such as a thumb drive. 
  2. For fillable PDF documents, you must use Acrobat Reader DC (or Adobe Acrobat DC) to ensure the forms work as intended. If you do not have Acrobat Reader DC, a free edition can be downloaded from the Adobe website. 
  3. If you have technical difficulties completing the forms online, you may print all of the blank forms and fill them out by hand to file with the court. Please check with your local court for further instructions. 
  4. You are responsible for the completeness and accuracy of any information submitted on the forms. Please double-check the information you enter! 
  5. Use the Tab key to move from field to field within a form. Hover the cursor over a fillable field to view help text associated with a field. Check boxes can be selected by pressing the space bar or clicking the box. To remove a check mark, press the space bar or click the check box again. Questions requiring only one check box be selected cannot be unselected.  

Civil Case on Appeal - Legal File Certified Copies: This form is used by a person who is appealing a circuit court judgment to ask the circuit clerk to make official copies of documents.

Execution Application and Order: This form is used by a person who is filing an application for execution to seek the courts assistance in collecting a money or property judgment due the applicant.

Garnishment Application and Order: This form is used by a person who is filing an application for garnishment to seek the courts assistance in collecting a money judgment due the applicant.

Statement of Judgment Balance Remaining Due: This form is used by a garnishor to file a statement of judgment balance pursuant to Rule 90.19(b).

Judgment Debtor's Claim for Exemption: This form is used by a person to claim a head of family exemption or other exemption when a garnishment has been filed against them. The claim for exemption must be filed with the circuit court issuing the writ of garnishment, served upon your employer, and mailed to the garnishor.

Interrogatories to Garnishee: If the court has entered a judgment for money, this form is used to ask the court to issue a garnishment order against the defendant. The interrogatories ask the garnishee to list all property or money owed to or held for the defendant and to state the name of anyone else who owes property or money to the defendant.

Itemization of Judgment: This form is used for itemization of damages in judgment for Chapter 535 actions. Supreme Court Rule 74.80 requires the itemization of judgment be entered in a form for any action filed pursuant to Chapter 535, RSMo.

Petition for Review of SATOP Assessment Assignment Recommendation: When a person is dissatisfied with the assessment assignment recommendation made by a substance abuse traffic offender program provider, they may file a “Petition for Review of SATOP Assessment Assignment Recommendation.” Along with the petition, the person must include a copy of the “SATOP Offender Assignment” (Form A3).

Motion for Substitution: This form is used to ask the court to replace a party in a case with another person. Substitutions may be granted when a party dies, becomes mentally ill, or transfers his or her interest in property to another person.

Motion to Vacate, Set Aside, or Correct the Judgment or Sentence: This form is used to ask the court to vacate, set aside or correct a judgment or sentence in a criminal case where the crime was a felony.

Notice of Civil Action to Recover Damages: This form is used by a person who has purchased or leased merchandise for personal, family or household purposes and has suffered a loss of money or property because of an unlawful action or method employed in the selling or leasing of such merchandise under section 407.025, RSMo.

Satisfaction of Judgment: Once a defendant has paid-off a judgment, this form is used by the person receiving the money or property to let the court know that the judgment has been paid. Do not use this form to satisfy a judgment that contains an ongoing obligation, i.e. child support or maintenance. This form cannot satisfy any child support or maintenance owed to the State of Missouri.

Acknowledgement of Pleadings and/or Documents in Dissolution of Marriage, Divorce, Alimony and/or Separate Maintenance Action: This form is used by a person that is a party to a Dissolution of Marriage, Divorce, Alimony and/or Separate Maintenance to verify all information provided in specified pleadings or documents is true and accurate.

Parenting Plan: In a dissolution (divorce) of marriage, legal separation, modification or paternity case, each parent must file a parenting plan. This form will help the court make decisions regarding child support, custody and visitation.

Petition for Establishing Record of Birth After 12th Birthday: After an application to the Bureau of Vital Records for a certificate of birth has been rejected, this form is used to file an application with the court for an order to be issued directing the Bureau of Vital Records to issue a certificate of birth in accordance with Section 193.115, RSMo. Documentation, as specified within the attached petition and as required by statute, must be filed with the petition.

Affidavit for Payment to Sheriff by Appointed Server: This form is used to provide the court with confirmation that payment for the deputy sheriff salary supplementation fund was made directly to the sheriff, in counties that receive these funds, by the special process server. Upon return this form should be included with the confirmation of return of service for cases with civil processes.

Petition for Removal of Unlawful Occupant of Property Containing a Residential Dwelling: This form is used by a property owner, or an authorized agent of a property owner, of property containing a residential dwelling being unlawfully occupied by someone who is not a tenant, former tenant, or immediate family member of the property owner. This form is to be filed in the county where the property is located.

After a petition is filed, a judge will review it. If the judge finds good cause, the judge will immediately issue an order to remove the respondent. An order of removal takes effect when entered and remains in effect until the respondent has been served with the petition and a court hearing is held. A hearing shall be held within 48 hours of filing of the verified petition, unless good cause is shown for the delay. An order of removal shall be to protect the petitioner from trespass by an unlawful occupant (or unlawful occupants) and may include other terms the judge deems necessary to ensure the petitioner’s safety.

The petition (CV365) includes an additional form:

  • CV365A Petition for Removal of Unlawful Occupant of Property Containing a Residential Dwelling – Addendum: This form is used when the petitioner is asking the court for removal of more than one unlawful occupant. One addendum is needed for each additional unlawful occupant.

NOTE: Court clerks can explain to the property owner or authorized agent the procedures for filing all forms and pleadings necessary for submitting the petition to the court.

A Confidential Case Filing Information Sheet - Non-Domestic Relations is also required at the time of filing of a petition for removal of unlawful occupant of property containing a residential dwelling.
