Rule 18. Electronic Filing and System-Generated Legal Files

(a) Applicable Rules. Unless otherwise ordered by this court, electronic filings shall be made as provided in Supreme Court Rule 103, Supreme Court Operating Rule 27, and this rule and no paper copies of electronic filings are required.

(b) Registered Users. Any lawyer who is a member in good standing of the Missouri Bar and represents a party on appeal in this court shall be a registered user of the electronic filing system.

(c) Required Format for Certain Documents. The following documents shall be filed in searchable PDF format:

            (1) Applications and motions;

            (2) Suggestions;

            (3) Briefs;

            (4) Petitions for a writ;

            (5) Answers to a writ; and

            (6) Transcripts.

(d) Service and Proof of Service in Initial Filings. Case-initiating documents filed electronically in this court shall be served on the parties and attorneys and proof of service filed in accordance with Supreme Court Rules 43.01 and 81.006(a). Case-initiating documents in this court include:

            (1) Petitions for original remedial writs;

            (2) Petitions for permission to appeal class action certification;

            (3) Motions for late notice of appeal;

            (4) Petitions to reschedule or relocate an election under § 115.024 RSMo.

(e) Notices. The court may serve notices, opinions, and other documents on registered users through the electronic filing system and on all others as provided in Supreme Court Rule 43.01. If a party is represented by multiple attorneys and any such attorney is a registered user, this court shall serve notice only to the registered user(s).

(f) Exhibits. Copies of trial exhibits may be filed electronically with this court if the opposing party consents. An index of the exhibits filed electronically shall also be included. Any original photographs or oversize exhibits must be deposited pursuant to Special Rule 4 and Supreme Court Rule 81.16.

(g) E-mail and Facsimile Filings Not Permitted. A registered user or anyone eligible to be a registered user of the electronic filing system may not file documents by e-mail or facsimile transmission.

(h) System-Generated Legal Files. In addition to the requirements of Supreme Court Rule 81.12(b)(1), when designating documents for inclusion in a system-generated legal file or system-generated supplemental legal file, parties should designate only unredacted versions of documents whenever possible. If a redacted document was filed with a confidential redacted information filing sheet (CRIFS) only and no unredacted version is available for designation, parties should designate the redacted document and the CRIFS.
