Rule 20. Briefs in Rules 24.035 and 29.15 Post-Conviction Appeals—Timeliness Statement
(a) In any appeal from a Rule 24.035 or 29.15 post-conviction proceeding, the appellant’s brief shall include a concise statement factually demonstrating the timely filing of both the movant’s initial motion and any amended motion.
(b) If the respondent is dissatisfied with the accuracy or completeness of the appellant’s timeliness statement, the respondent's brief may include a timeliness statement.
(c) A timeliness statement shall be positioned in a brief immediately after the position for a jurisdictional statement and immediately before the position for a statement of facts.
(d) All statements of facts in a timeliness statement shall have specific page references to the relevant portion of the record on appeal, i.e., legal file, transcript, or exhibits. If the matter cited is also contained in the appendix, a page reference to the appendix shall be included.
