Filing Fee and Motions for Leave to Proceed In Forma Pauperis
The filing fee is $70 unless you are filing a motion for leave to proceed in forma pauperis or are exempt from paying the filing fee. If you are filing a motion for leave to proceed in forma pauperis, it should be the first document attached. Pro se litigants (those not represented by an attorney) should include detailed information about income, assets, debts, liabilities, etc. in this motion. This Court does not provide forms to use to prepare a motion to proceed in forma pauperis.
Formatting Instructions
The Form 15 cover page to the application for transfer:
- Should be in a separate PDF file from the application for transfer document and shall be prepared in no smaller than 13 point, Times New Roman font.
- Can be single-spaced and can run as many pages as needed to provide the information requested on the form.
- This Court provides the Form 15 cover page in an interactive Microsoft Word version and a non-interactive PDF version online. This is the only form this Court provides with regard to the filing of applications for transfer.
The application for transfer document:
- Should be in a separate PDF file from the Form 15 cover page, shall be prepared in no smaller than 13 point, Times New Roman font, and shall not exceed 12 pages (including any suggestions in support).
- Shall have line spacing not less than 1.5, except that the following may be single-spaced: the caption (though you are not required to repeat the caption at the beginning of the application for transfer document as the Form 15 cover page to the application for transfer contains that information); headings; quotations more than two lines long; footnotes; certificate of service; and signature block.
- The signature block can be on the 13th page, but you may not finish a sentence or a footnote on the 13th page.
- A certificate of service showing service of the application for transfer and all attachments upon all counsel of record and self-represented litigants, including names and appropriate addresses for the method of service shown, should follow the signature block at the end of the application.
Please note the electronic filing system does not provide service on a new case. Service must be made by regular mail, overnight courier, hand delivery, facsimile, or via electronic mail.
Required attachments to the application for transfer (each document listed below should be in a separate PDF file):
- The opinion, order and memorandum, or order issued by the Missouri Court of Appeals.
- The motion for rehearing, if any, and the application for transfer.
- The order/notice from the court of appeals overruling the motion for rehearing, if any, and denying the application for transfer.
- The proof of notice to the clerk of the court of appeals and each opposing party/counsel to the application for transfer shall be filed in the case pending in the court of appeals and attached as an attachment to your submission to the Supreme Court of Missouri.
Electronic documents submitted to this Court shall not contain any active hyperlinks other than those generated by the electronic filing system. See Rule 103.04.
