Privacy Requests for Judicial Officers

Judicial Privacy Request

Per the Judicial Privacy Act (sections 476.1300 to 476.1313, RSMo), a court-related officer may request Missouri’s state agencies remove personal information from publicly available content for privacy and safety.

A “court-related officer” is defined by section 476.1300, RSMo as actively employed, formerly employed or retired Justices of the Supreme Court of the United States; Judges of the United States Court of Appeals; Judges and magistrate judges of the United States District Courts; Judges of the United States Bankruptcy Court; Judges of the Supreme Court of Missouri; Judges of the Missouri Court of Appeals; judges and commissioners of the Missouri circuit courts, including the divisions of a circuit court; prosecuting or circuit attorney, assistant prosecuting or circuit attorney, and any employee of a prosecuting or circuit attorney; court administrators, circuit clerks, deputy circuit clerks, division clerks and municipal clerks; and juvenile officers and chief deputy juvenile officers.

Immediate family members who reside at a court-related officer’s residence also may be included to remove personal information from publicly available content. Eligible family members include the court-related officer’s spouse, unmarried companion, child, adoptive child, foster child, parent, or other family member of the court-related officer or spouse who lives in the same residence.

Information that will be made confidential includes home address, secondary home address, home telephone number, mobile telephone number, pager number, personal email address, Social Security number, federal tax identification number, checking and savings account numbers, credit card numbers, marital status, and identity of children under 18 years of age.

The Supreme Court of Missouri will send the information to Missouri’s state agencies quarterly. The agency then will have five days to remove the information from public access. Therefore, it may take up to three months for the personal information to be made confidential.
