In re:

Repeal of the heading title and subdivision 32.11, entitled "Misdemeanors or Felonies – Clerk File After Change of Venue – Failure to Transmit, or Loss of, Record," of Rule 32, entitled "Misdemeanors or Felonies – Venue Including Change of Venue and Change of Judge – Disability of Judge," and in lieu thereof adoption of a new heading title and a new subdivision 32.11, entitled "Misdemeanors or Felonies – Clerk File After Change of Venue."

ORDER

1.  It is ordered that, effective January 1, 2024, the heading title and subdivision 32.11 of Rule 32 be and the same are hereby repealed and a new heading title and a new subdivision 32.11 are hereby adopted in lieu thereof to read as follows:

32.11  MISDEMEANORS OR FELONIES – CLERK TO TRANSMIT FILE AFTER CHANGE OF VENUE

(a) When an order of change of venue is made, the clerk shall forthwith transmit the electronic court file to the clerk of the court to which the removal is ordered.

(b) At the time of transmittal, the clerk shall certify that a copy of the docket sheet and all claims for payment of costs filed with the court to date are included, and that the costs and fees information provided is an accurate accounting of all costs and fees that accrued in the case.

2.  It is ordered that notice of this order be published in the Journal of The Missouri Bar.

3.  It is ordered that this order be published in the South Western Reporter.
