(1) Repeal of subdivision 6.01(f), entitled "Automatic Suspension,” of Rule 6, entitled “Fees to Practice Law,” and in lieu thereof adoption of a new subdivision 6.01(f), entitled "Automatic Suspension.”

(2) Repeal of subdivision 9.01, entitled "Unauthorized Practice by Foreign Attorneys,” of Rule 9, entitled “Practice by Nonresident Attorneys,” and in lieu thereof adoption of a new subdivision 9.01, entitled "Unauthorized Practice by Foreign Attorneys.”

(3) Repeal of Criminal Procedure Form No. 36.



1.  It is ordered that effective January 1, 2009, subdivision 6.01(f) of Rule 6 be and the same is hereby repealed and a new subdivision 6.01(f) adopted in lieu thereof to read as follows:

6.01  ANNUAL ENROLLMENT FEE AND STATEMENT - EXEMPTIONS - PENALTIES - PRO HAC VICE FEE

(f) Automatic Suspension.  As provided in Rule 6.05, no lawyer shall be permitted to practice law or undertake or attempt to do a law business after the time the lawyer's name is stricken from the roll of attorneys pursuant to Rule 6.02.  In default of timely paying the annual enrollment fee, the lawyer shall be subject to automatic suspension.  Any lawyer thus suspended for such nonpayment shall be retroactively reinstated as a matter of course upon paying the enrollment fee prescribed for each calendar year of the suspension plus the accumulated penalty.  If any lawyer remains delinquent for three consecutive years in the payment of any annual enrollment fee, the lawyer shall be required to apply to this Court under Rule 5.28 for reinstatement as a member in good standing.

2.  It is ordered that effective January 1, 2009, subdivision 9.01 of Rule 9 be and the same is hereby repealed and a new subdivision 9.01 adopted in lieu thereof to read as follows:

9.01  UNAUTHORIZED PRACTICE BY FOREIGN ATTORNEYS

No nonresident attorney shall practice law or do a law business in this state except as provided in Rules 4-5.5, 9.02, 9.03 and 9.04.

3.  It is ordered that Criminal Procedure Form No. 36 is repealed.

4.  It is ordered that notice of this order be published in the Journal of The Missouri Bar.

5.  It is ordered that this order be published in the South Western Reporter.
