In re:

(1) Repeal of subdivision (c) of subdivision 33.17, entitled "Misdemeanor or Felonies - Bonds - Surety, Individual - Qualifications," of Rule 33, entitled "Misdemeanor or Felonies - Release Pending Further Proceedings," and in lieu thereof adoption of a new subdivision (c) of subdivision 33.17, entitled "Misdemeanor or Felonies - Bonds - Surety, Individual - Qualifications."   

(2) Repeal of subdivision (c) of subdivision 37.29, entitled "Bonds - Surety, Individual - Qualifications," of Rule 37, entitled "Statutory and Ordinance Violations and Violation Bureaus," and in lieu thereof adoption of a new subdivision (c) of subdivision 37.29, entitled "Bonds - Surety, Individual - Qualifications."


1.  It is ordered that effective January 1, 2007, subdivision 33.17(c) of Rule 33 be and the same is hereby repealed and a new subdivision 33.17(c) adopted in lieu thereof to read as follows:

33.17  MISDEMEANORS OR FELONIES - BONDS - SURETY,
INDIVIDUAL - QUALIFICATIONS

A person shall not be accepted as a surety on any bail bond unless the person:

(c) Has not, within the past 15 years, been found guilty of or pleaded guilty or nolo contendere to:
(1) Any felony of this state, any other state, or the United States; or
(2) Any other crime of this state, any other state, or the United States involving moral turpitude,
whether or not a sentence was imposed;

2.  It is ordered that effective January 1, 2007, subdivision 37.29(c) of Rule 37 be and the same is hereby repealed and a new subdivision 37.29(c) adopted in lieu thereof to read as follows:

37.29  BONDS - SURETY, INDIVIDUAL - QUALIFICATIONS

A person shall not be accepted as a surety on any bail bond unless the person:
