In re:

Adoption of a new Court Operating Rule 22.01, entitled "Court en banc Review of Division Opinions."

1.  It is ordered that Court Operating Rule 22.01 be and the same is hereby adopted to read as follows:

22.01 Court en banc Review of Division Opinions
Each district of the court of appeals shall establish a procedure by local court rule requiring en banc review of a division opinion within the district that chooses not to follow a previous decision of an appellate court of this state.  The procedure shall require that such case be reheard by the court en banc.  The procedure also may include as an alternative to rehearing the case en banc that an order shall be entered indicating that the district has reviewed the opinion en banc.

2.  The state courts administrator shall provide copies of this order to each chief judge and clerk of each district of the court of appeals and such other persons as the administrator deems appropriate.
