In re:Repeal of Regulation 4 of the Board of Law Examiners to subdivision 8.06, entitled "Applications for Admission to The Bar With Examination;" of Regulation 13 of the Board of Law Examiners to subdivision 8.08, entitled "The Bar Examination;" and of Regulation 3 of the Board of Law Examiners to subdivision 8.09, entitled "Failure to Pass Examination" of Supreme Court Rule 8, entitled "Admission to the Bar," and in lieu thereof adoption of new Regulation 4 of the Board of Law Examiners to subdivision 8.06, a new Regulation 13 to subdivision 8.08, and a new Regulation 3 of the Board of Law Examiners to subdivision 8.09.
ORDER
1. It is ordered that effective July 1, 2000, Regulation 4 of the Board of Law Examiners to subdivision 8.06, Regulation 13 of the Board of Law Examiners to subdivision 8.08, and Regulation 3 of the Board of Law Examiners to subdivision 8.09 be and the same are hereby repealed and a new Regulation 4 of the Board of Law Examiners to subdivision 8.06, a new Regulation 13 to subdivision 8.08, and a new Regulation 3 of the Board of Law Examiners to subdivision 8.09 enacted in lieu thereof to read as follows:- 8.06 APPLICATIONS FOR ADMISSION TO THE BAR WITH

4. An applicant who has filed an application under this Rule 8.06 may be permitted to carry forward the application to the next scheduled examination without the filing of an additional fee upon:* * *
(a) Applicant's written request; and
(b) A showing of good cause.
The written request must be made prior to the start of the examination for which the applicant is registered. Under extraordinary circumstances, the board may waive the requirement that the written request be made prior to the start of the examination.
If the request is granted, the applicant shall file an affidavit certifying:
(a) There are no changes to the information provided on the applicant’s application for bar examination; or
(b) Setting forth in detail the nature and extent of any changes that have occurred.
The affidavit shall be in a form prescribed by the board. The affidavit shall be filed on or before the due date for the filing of an original application under Rule 8.06(a).
The board, in its discretion, may require a new character and fitness examination if warranted by changes shown in the affidavit. If a new examination is required, the applicant shall be so notified. Within ten days following such notification, the applicant shall pay a fee prescribed by the board.
An applicant who fails to file the prescribed affidavit or to pay the prescribed fee, if any, within the required time shall:
(a) Be deemed to have withdrawn the application for bar examination;
(b) Not be permitted to sit for the bar examination; and
(c) Be required to file a new application, with all required fees, if the applicant desires to sit for a future bar examination.
8.08 THE BAR EXAMINATION

(a) Make public statistical results of the examination;
(b) Disclose to the law school from which an applicant graduated the applicant’s grades, provided the applicant has signed a release form authorizing the board to do so; and
(c) Certify, upon an applicant's request, an applicant's Multistate Bar Examination to other jurisdictions in which the applicant seeks admission.
8.09 FAILURE TO PASS EXAMINATION

3. An applicant failing to achieve a combined passing score on three successive examinations may only take additional examinations upon completion of the required hours of assisted and/or independent study and review of the law. An applicant must submit to the board evidence of completion of at least 240 hours study and review of the law since the applicant’s last examination in Missouri or in the preceding calendar year, whichever is shorter. * * *
Evidence of completion of the required 240 hours of study and review must be submitted to the board in the format specified by the board no later than ten days prior to the date of each additional examination.
Except for extraordinary circumstances approved by the board, failure to submit the required proof of study and review within the time specified will result in forfeiture of application fees.
