In re: Additions to MAI-CR 3d
 
 
MAI-CR 310.02 – EYEWITNESS IDENTIFICATION TESTIMONY
 
 
1. On March 2, 2015, this Court entered an order, to be effective January 1, 2016, adopting a new MAI-CR 310.02 - EYEWITNESS IDENTIFICATION TESTIMONY with notes on use. The Court received numerous comments concerning the proposed instruction. After careful consideration, effective January 1, 2016, the Court hereby vacates the previously adopted instruction and notes on use.
 
2. Effective January 1, 2016, the additions to previously approved criminal instructions and Notes on Use (MAI-CR 3d) as listed above are hereby adopted and approved.
 
3. The additions as set forth in the specific exhibits attached hereto must be used and followed on and after January 1, 2016, and may be used and followed prior thereto, and any such use shall not be presumed to be error.
 
4. It is further ordered that the above Table of Instructions and this Order be published in the Journal of The Missouri Bar and the South Western Reporter.
