ORDER


WHEREAS, the Chief Disciplinary Counsel has filed an Information and motion for final discipline recounting Respondent's, Warren Steven Rives, plea of guilty to a misdemeanor charge of official misconduct in violation of section 576.040, RSMo; and

The violation resulted from Respondent's, Warren Steven Rives, service as a city prosecutor of Lake Ozark, Missouri, and his receipt in that capacity of a fee in excess of the fee due from a defendant charged with a municipal violation; and

The Court finds that Respondent, Warren Steven Rives, has violated Rule 4-8.4(b) by committing a criminal act reflecting adversely on the lawyer's honesty, trustworthiness, or fitness as a lawyer and that he should be disciplined;

Now, therefore, it is ordered that Respondent, Warren Steven Rives, is hereby suspended from the practice of law and that no petition for reinstatement will be entertained for a period of six months from the date of this order.

It is further ordered that any application for reinstatement under Rule 5.28(h)(1) shall be accompanied by certification of successful completion of the course “Getting your Law Practice on Track” furnished by the Office of Chief Disciplinary Counsel.

It is further ordered that Warren Steven Rives comply in all respects with Rule 5.27 - Notification of Clients and Counsel.

Fee of $1,000.00 pursuant to Rule 5.19(h) assessed against Respondent, Warren Steven Rives, payable to the Clerk of this Court for the benefit of the Advisory Committee Fund.

Costs taxed to Respondent, Warren Steven Rives.
