Forms
Several forms are available for use in small claims - those actions in which the amount of the claim does not exceed five thousand dollars ($5,000.00). Small claims may only involve claims for money and may not be used for the return of goods or property. The persons involved may represent themselves without an attorney. Court proceedings are conducted informally before a judge, without a jury. A person may file no more than 12 claims in small claims court in any calendar year. How to use the forms:
- You must save each form before you begin entering information in the form fields. Court: This form is used by a person to file a small
claims court case and is being filed against another person or party to recover
money.
If a person receives this form by mail, in person or by some other method of delivery, they are the defendant in a small claims court action. The plaintiff is claiming to be an injured party and filing a claim against the defendant in a small claims court action.

Petition for a Minor - Small Claims Court: This form is used by a person who is requesting the court to appoint them as a Next Friend (a person or agency representing a minor, acting on his or her behalf in a court action) and assisting the minor in the filing of a claim in small claims court.
The minor is the plaintiff in the small claims court case and is filing a suit against another person or party.
Counterclaim Small Claims Court: This form is used by the defendant in a small claims court action who wishes to file a claim against the person who brought the original small claims action.

Dismissal Small Claims Court: This form is used by a person requesting to dismiss a small claims court case in which they are either the plaintiff or defendant. If the initial claim is being dismissed, the plaintiff is the only person who may dismiss the claim. If a counterclaim is being dismissed, the defendant is the only person who may dismiss the counterclaim.
