Adult Abuse/Stalking Forms
Pursuant to the Missouri Domestic Violence Act, chapter 455, RSMo, a person may seek an order of protection from acts, attempts or threats to him or her from a family or household member or intimate partner; or from acts of stalking or sexual assault. The petitioner must be 17 years of age or older or must otherwise be emancipated ('on your own,’ such as married or a member of the military).

NOTE: Court clerks will provide assistance in completing these forms. A Confidential Case Filing Information Sheet is also required to be filed with each domestic relations case filed. The Filing Information Sheet page provides more information and the required form.
How to use the forms:
- You must save each form before you begin entering information in the form fields. Right click the link for a form and save it to your computer before you begin entering information in the form fields. If you are downloading the form from a public computer, be sure to save the form to a personal device, such as a thumb drive.
- For fillable PDF documents, you must use Acrobat Reader DC (or Adobe Acrobat DC) to ensure the forms work as intended. If you do not have Acrobat Reader DC, a free edition can be downloaded from the Adobe website.
- If you have technical difficulties completing the forms online, you may print all of the blank forms and fill them out by hand to file with the court. Please check with your local court for further instructions.

- Use the Tab key to move from field to field within a form. Hover the cursor over a fillable field to view help text associated with a field. Check boxes can be selected by pressing the space bar or clicking the box. To remove a check mark, press the space bar or click the check box again. Questions requiring only one check box be selected cannot be unselected.
Petition for Order of Protection - Adult: This form is used by a person requesting a full order of protection against another adult (person over the age of 17). A full order of protection prohibits the person who it is issued against from further acts, attempts or threats of abuse, stalking, or sexual assault. The petition may request additional relief such as maintenance, child custody, child support and/or visitation. A full order of protection is issued for a specific period of time - at least 180 days but not to exceed one year.
In order to qualify for an order of protection, the petitioner must be a family member, household member or intimate partner living with or without the respondent, or an adult who has been the victim of stalking or sexual assault. A “family or household member” is defined as husband/wife, former husband/wife, adults related by blood or marriage, adults who are presently living together or have lived together in the past, adults who are or have been in a continuing social relationship of a romantic or intimate nature, and adults who have a child or children together regardless of whether they have been married or have lived together at any time.
The petition will be presented to a judge immediately after filing. If the petitioner is found to be in imminent danger, the judge will issue an ex parte (immediate) order of protection before the hearing date scheduled. The ex parte order of protection is effective until a hearing on the petition for full order of protection is held.
The petition (AA40) includes two additional forms:

- AA 40A Confidential Redacted Information Filing Sheet – This form is used when children are involved in the protection order to determine custody.
- AA 40 Exhibit A – This form is used when the petitioner is asking the court to order custody of more than five children. Information for children six through ten need to be added to this form.

Motion for Renewal of Full Order of Protection - Adult: This form is used by a person filing a motion with the court to renew a full order of protection issued against another adult to prohibit further acts, attempts or threats of abuse, stalking, or sexual assault. The full order of protection may be renewed up to two times for additional periods of at least 180 days but not to exceed one year each, upon motion of either party and after hearing by the court. If a hearing cannot be held to renew the original full order before it expires, an ex parte (immediate) order can be issued until the hearing on the motion can be held.

Affidavit of Foreign Order of Protection - Adult: This form is used if a person has been granted an order of protection by a court outside the state of Missouri and are filing the proper documents with a court in Missouri so that the “foreign” order of protection can be entered into the Missouri Uniformed Law Enforcement System (MULES) to be accessible by all law enforcement officials and agencies, and all public officials in Missouri. Foreign orders of protection are given full faith and credit in the state of Missouri and enforced in the same manner as any order of protection issued by a court in Missouri whether filed with a Missouri court or not.
Motion to Terminate Full Order of Protection - Adult: This form is used by a person who received a full order of protection against another adult to request termination of the full order of protection. Prior to terminating any order of protection, the court may inquire of the person who received the order or others to determine whether the dismissal is voluntary.

Request to Dismiss Petition for Order of Protection - Adult: This form is used by a person who filed a petition for a full order of protection against another adult to request a dismissal of the petition for order of protection. Prior to dismissing the petition for order of protection, the court may inquire of the person who requested the order or others to determine whether the dismissal is voluntary.

Affidavit of Changes in Circumstance and Motion to Modify Judgment of the Full Order of Protection - Adult: This form is used by the person filing to advise the court of changes in circumstances and requests by motion for the court to modify a previously ordered judgment of the full order of protection.
Any order of child support, custody, temporary custody, visitation or maintenance entered pursuant to the Adult Abuse Act shall end before the original fixed expiration date whenever another court order is granted at a later date for child support, custody, temporary custody, visitation or maintenance, arising out of a separate action. For example, a separate child support order is granted after an order of protection. The separate child support order granted at the later date is then in effect and any child support orders that were originally a part of the order of protection would be ended and no longer in effect.
