In re:

Adoption of a new subdivision (f) of subdivision 5.21, entitled "Interim Suspension and Final Discipline for Criminal Activities," of Rule 5, entitled "Complaints and Proceedings Thereon."

ORDER

1. It is ordered that effective January 1, 2019, subdivision 5.21(f) of Rule 5 be and the same is hereby adopted to read as follows:

5.21 INTERIM SUSPENSION AND FINAL DISCIPLINE FOR CRIMINAL ACTIVITIES

(f) The chief disciplinary counsel, regional disciplinary committee, or any division thereof, may defer making a recommendation or imposing discipline concerning a lawyer subject to discipline as provided in Rule 5.21(a) pending the lawyer's successful or unsuccessful completion of a treatment court program, and may consider the lawyer's successful or unsuccessful completion of a treatment court program in such recommendation or imposition of discipline. This provision shall not apply to a lawyer whose license has been subject to interim suspension under Rule 5.21(b).

2. It is ordered that notice of this order be published in the Journal of The Missouri Bar.

3. It is ordered that this order be published in the South Western Reporter.
