ORDER
The Chief Disciplinary Counsel having filed an information and motion for reciprocal discipline pursuant to Rule 5.20 advising this Court of its finding, after investigation, that Respondent, Daniel J. Martinez, was reprimanded in the Supreme Court of Kansas Case No. 124,395.
A show cause order was issued on March 28, 2023, and Respondent filed a response to the same.
This Court finds that Respondent has violated the Rules of Professional Conduct and should be disciplined; and
Said discipline is the result of conduct that is a violation of Rules 4-1.1, 4-1.4(a), 4-1.4(b), 4-1.5(a), 4-1.15(a), 4-1.16(d), 4-3.4(c). 4-7.1, and 4-8.4(d) of the Rules of Professional Conduct.
Now, therefore, this Court sustains the motion for reciprocal discipline and suspends Respondent, Daniel J. Martinez, indefinitely with no leave to apply for reinstatement for two years. The suspension is stayed, and Respondent is placed on probation for a period of two years from the date of this order in accordance with Rule 5.175. The conditions of probation are those set forth in the term and conditions filed herein (attached to the Information and Motion for Reciprocal Discipline as Exhibit 4 filed on March 27, 2023).
Fee pursuant to Rule 5.19(k) in the amount of $1,500.00 payable to the Clerk of this Court to the credit of the Advisory Committee Fund taxed to Respondent.
Costs taxed to Respondent.
