In re: Charles E. Polk, Jr., MBE # 35839
ORDER
The Chief Disciplinary Counsel having filed a motion for discipline pursuant to Rule 5.21(c) advising this Court of its finding, after investigation, that Respondent, Charles E. Polk, Jr., pled guilty to one count of violation of Title 26, Section 7201 and one count of violation of Title 18, Sections 2 and 2314 in the United States District Court for the Eastern District of Missouri in Case No. 4:05CR157SNL and that Respondent’s conviction is finally disposed for the purposes of Rule 5.21(c);
Respondent having previously been suspended from the practice of law in this State on an interim basis by order of the Court dated June 14, 2006, in SC87648;
The Court finds that Respondent is guilty of professional misconduct and should be disciplined;
Now, therefore, it is ordered by the Court that the said Charles E. Polk, Jr., be, and he is hereby disbarred, that his right and license to practice law in the State of Missouri is canceled and that his name be stricken from the roll of attorneys in this State.
It is further ordered and adjudged that no petition for reinstatement shall be entertained by the Court until restitution in the amount specified by the United States District Court for the Eastern District of Missouri in Case No. 4:05CR157SNL has been satisfied in full;
It is further ordered that the said Charles E. Polk, Jr., comply in all respects with Rule 5.27 - Notification of Clients and Counsel.
Costs taxed to Respondent.
