Note: Michael J. Kuster's probation was terminated June 26, 2013 by order of the Court.
ORDER
Informant having filed a statement of acceptance of the Disciplinary Hearing Panel decision pursuant to Rule 5.19(c) which accepted the joint stipulation of facts, joint proposed conclusions of law and joint recommended discipline and probation agreement filed by the parties advising that Respondent violated Rules 4-8.4(a), 4-1.1, 4-1.3, 4-1.4 and 4-8.1(c) of the Rules of Professional Conduct; and
The Court finds that Respondent has violated Rule 4-8.4(a), 4-1.1, 4-1.3, 4-1.4 and 4-8.1(c) of the Rules of Professional Conduct and should be disciplined.
Now, therefore, it is ordered that Respondent, Michael J. Kuster, is hereby suspended from the practice of law for a period of six months from the date of this order. The suspension is stayed, and Respondent, Michael J. Kuster, is placed on probation as provided in Rule 5.225. The probation is for a period of two years from the date of this order. The conditions of probation shall be those specified in Rule 5.225 and the conditions set forth in the probation agreement of the parties attached to the joint stipulation of facts, joint proposed conclusions of law and joint recommended discipline filed herein on October 24, 2008.
If a failure to comply with the conditions of probation is determined to have occurred pursuant to Rule 5.225(f), the suspension previously stayed will be imposed with leave to apply for reinstatement after not less than six months.
Fee of $1,000.00 as per Rule 5.19(h) assessed against Respondent and shall be paid to the Clerk of this Court to the credit of the Advisory Committee Fund.
Costs taxed to Respondent.
