ORDER

Now at this day, the Court being sufficiently advised of and concerning the premises and having considered the statement of acceptance of the Disciplinary Hearing Panel decision pursuant to Rule 5.19(c), the Court finds that in Count I Respondent, Brandy M. McShane, Missouri Bar No. 44606, violated Rules 4-1.3 and 4-1.4 by neglecting her court ordered duties as an attorney for the estate in a guardianship/conservatorship proceeding and by failing to adequately communicate with her client. Respondent also violated Rule 4-8.1 by failing to respond to the disciplinary requests for information about Count I. In Count II, Respondent, Brandy M. McShane, violated Rules 4-1.3 and 4-1.4 by failing to act diligently and by failing to adequately communicate with her clients in her representation of a couple who had retained her for estate planning. In Count III, Respondent, Brandy M. McShane, violated Rules 4-1.3 and 4-1.4 by failing to act diligently and by failing to adequately communicate with clients in her representation of a different couple who had retained her for estate planning. In accordance with previous disciplinary decisions of this Court, Respondent’s license is suspended.  The suspension is stayed pursuant to Rule 5.225 and Respondent is placed on probation under the additional terms and conditions agreed to by the parties in their Joint Stipulation and described in the “Suggested Terms and Conditions of Probation” approved by the Disciplinary Hearing Panel.

Fee pursuant to Rule 5.19(h) in the amount of $1,000.00 payable to the Clerk of this Court to the credit of the Advisory Committee fund taxed to Respondent.

Costs taxed to Respondent.
