In re: Tarak A. Devkota, MBE No. 51604
ORDER
The Chief Disciplinary Counsel and Tarak A. Devkota filed a joint stipulation of facts, conclusions of law and joint recommendation of discipline herein;
Now being fully advised, the Court finds that Tarak A. Devkota violatedRules 4-1.3 (diligence), 4-1.4 (communication) of the Rules of Professional Conduct; and
The Court further finds that on December 9, 2005, Respondent was publicly censured by the Supreme Court of Kansas in Case No. 94,801 for conduct which violates Rules 4-1.3 (diligence), 4-3.4(d), (failure to make reasonably diligent effort to comply with pretrial discover requests) and 4-8.4(c), (engaging in conduct involving dishonesty, fraud, deceit or misrepresentation) of the Missouri Rules of Professional Conduct.
After carefully considering the matter of the proper discipline, the Court orders that Tarak A. Devkota’s license to practice law is suspended and, pursuant toRule 5.225, the suspension is stayed, and Tarak A. Devkota is placed on probation for a period of twelve months from the date of this order. The conditions of probation are set forth on pages 12 through 19 of the joint stipulation of facts, joint proposed conclusions of law and joint recommendation of discipline filed by the parties herein.
Costs taxed to Respondent.
