ORDER
Now on this 22nd day of December, 2009, this Court having reviewed the information for suspension pursuant to Rules 5.23(b) and 5.23(c), wherein Informant advised that Respondent is unable to practice law due to mental incapacity, and finding that there is probable cause to believe that the Respondent is unable to competently represent the interests of Respondent’s clients, it is hereby ordered that Respondent is suspended on an interim basis from the practice of law pursuant to the provisions of Rule 5.23(c). Said suspension is to remain in place until further order of this Court.
It is further ordered that James Esten Pennoyer, comply in all respect with Rule 5.27 - Notification of clients and counsel.
Costs taxed to Respondent.
