Note: Mr. Briegel's probation was terminated by order dated October 29, 2015.

ORDER

Now at this day, the Court being sufficiently advised of and concerning the premises and having considered the stipulation and statement of acceptance of the Disciplinary Hearing Panel filed by the parties herein;

The Court finds that Respondent, Daniel James Briegel, Missouri Bar No. 44476, violated Rules 4-1.2 (abiding by wishes of client), 4-1.3 (diligence), 4-1.4 (communication), 4-
1.15(c)
(holding client property separate from attorney property), 4-1.15(d) (maintaining trust account records), 4-1.15(e), (attorney funds not allowed to be held in trust account), 4-1.15(m),(storing client files securely), 4-8.1(c), (responding to demands for information from disciplinary counsel) and 4-8.4(c), (conduct prejudicial to administration of justice and dishonesty) of the Rules of Professional Conduct;.

Upon consideration of these findings, previous decisions of this Court, ABA Standards for Imposing Lawyer Discipline, and aggravating and mitigating circumstances, the Court suspends Respondent’s license indefinitely with no leave to apply for reinstatement for a period of two years from the date of this order. The suspension is stayed and Respondent is placed on probation for three years from the date of this order in accordance with Rule 5.225 and the terms and conditions of probation attached to the decision of the disciplinary hearing panel filed herein.

Fee pursuant to Rule 5.19(h) in the amount of $1,000.00 payable to the Clerk of this Court to the credit of the Advisory Committee Fund taxed to Respondent.

Costs taxed to Respondent.
