Note: On August 10, 2012, an order terminating the probation was issued by the Supreme Court of Missouri.


ORDER


The Chief Disciplinary Counsel having filed an information and motion for reciprocal discipline pursuant to Rule 5.20 advising this Court of its finding, after investigation, that Respondent, Bryan W. Smith, has been suspended from practice of law with said suspension stayed and Respondent placed on probation by the Supreme Court of Kansas pursuant to the opinion of that Court in Case No. 103,860, issued on June 11, 2010;

Said discipline was the result of conduct that violated Rule 4-8.4(b) of the Rules of Professional Conduct; and

On July 13, 2010, this Court issued a show cause order to Respondent and Respondent filed a response to the corrected information and motion for reciprocal discipline;

The Court finds that Respondent has violated the Rules of Professional Conduct and should be disciplined;

Now, therefore, it is ordered by the Court that the motion for discipline is sustained in accordance with previous disciplinary decisions of this Court, the Court hereby suspends the license of Bryan W. Smith with no petition for reinstatement to be entertained for a period of one years from the date of this order with said suspension stayed and Respondent placed on probation for a period of two years from the date of this order in accordance with Rule 5.225 and the terms of probation ordered by the Supreme Court of Kansas. Further, no petition for reinstatement or motion for successful completion of probation shall be entertained by this Court until Respondent has successfully completed the probation ordered by the Supreme Court of Kansas.

Fee pursuant to Rule 5.19(h) in the amount of $1,000.00 payable to the Clerk of this Court to the credit of the Advisory Committee Fund taxed to Respondent.

Costs taxed to Respondent.
