ORDER
WHEREAS, the Office of Chief Disciplinary Counsel has filed a motion for final discipline pursuant to Rule 5.21(c) advising this Court that on January 22, 2007, Respondent pled guilty to one misdemeanor count of violation of 42 USC section 1320a-7b(a)(2), False Statements in Determining Rights to Receive Benefits or Payments Under a Federal Health Care Program, in the United States District Court for the Eastern District of Missouri in the case of United States of America vs. Charles B. Kaiser III, Case No. 4:07CR42DDN and said conviction is now final;
Respondent was previously suspended from the practice of law on November 23, 2004, in Supreme Court Case No. SC86308;
The Court finds that Respondent is guilty of professional misconduct and should be further disciplined;
Now, therefore, it is ordered by the Court that the time the Court will not entertain a petition for reinstatement by Charles B. Kaiser III is hereby extended and that no petition for reinstatement will be entertained until January 23, 2010.
It is further ordered that the said Charles B. Kaiser III comply in all respects with Rule 5.27 - Notification of Clients and Counsel.
Costs taxed to Respondent.
