In re:
Repeal of subdivision 12.13, entitled “Disposition of Record of Investigation Where There is No Recommendation,” of Supreme Court Rule 12, entitled “Commission on Retirement, Removal and Discipline,” and in lieu thereof adoption of a new subdivision 12.13, entitled “Disposition of Record of Investigation Where There is No Recommendation.”
ORDER
1. It is ordered that effective July 1, 2001, subdivision 12.13 of Supreme Court Rule 12 be and the same is hereby repealed and a new subdivision 12.13 adopted in lieu thereof to read as follows:
- 12.13. DISPOSITION OF RECORD OF INVESTIGATION WHERE THERE IS NO RECOMMENDATION
If no formal proceeding is instituted or if no recommendation is made by the Commission after a formal proceeding, the Commission shall seal the record thereof and deposit the same with the clerk of this Court. The record may be inspected only by order of this Court. Records deposited with the clerk for at least ten years may be destroyed unless objected to by the commission.
2. It is ordered that notice of this order be published in the Journal of The Missouri Bar.
3. It is ordered that this order be published in the South Western Reporter.
