ORDER

WHEREAS, Respondent was suspended on March 6, 2008, with no leave to apply for reinstatement for a period of one year from that date for violation of Rules 4-1.4, 4-3.5, 4-4.1, 4-5.1(b), 4-5.1(c), 4-8.4(c), 4-8.4(d) and 4-8.4(e) of the Rules of Professional Conduct; and

Respondent having filed a hardship application for probation pursuant to Rule 5.225 and the Chief Disciplinary Counsel having filed a response to the same;

Now, therefore, this Court's March 6, 2008 order is modified so that Respondent is hereby suspended from the practice of law for a period of one year from March 6, 2008. The suspension is stayed and Respondent, David Dalton, is hereby, placed on probation pursuant to Rule 5.225, and said probation is effective as of the date of this order. Said probationary period shall continue through December 31, 2009, pursuant to Rule 5.225.

All other provisions of the Court’s order dated March 6, 2008, remain in effect.

Costs taxed to Respondent.
