ORDER FOR INTERIM SUSPENSION AND APPOINTMENT OF TRUSTEE
Now on this 13th day of January, 2006, this Court having reviewed the Joint Stipulation filed herein on the 6th day of January, 2006, and having found that Respondent may be unable to competently represent the interests of his clients by reason of mental condition, it is hereby ordered that Respondent is suspended on an interim basis from the practice of law. Said suspension to remain in place until further Order of this Court.
The Court further finds that a Trustee should be appointed and that Ms. Rebecca (Bekki) Cook shall be appointed as Trustee. As Trustee, Ms. Cook shall:
a) locate and examine the client files and records of Respondent at whatever location such files may be found, and obtain information as to any pending matters which may require attention;
b) If Respondent has not already done so, notify persons and entities who appear to be clients of Respondent with pending matters, i.e. the file has not already been transferred to other counsel or closed, by first class mail at the last known address found in Respondent’s files that Respondent’s license has been interimly suspended and inform such clients that it may be in their best interests to obtain other legal counsel;
c) apply for extensions of time pending employment of such other counsel by the clients;
d) with the consent of a current client, file notices, motions and pleadings on behalf of the client where jurisdictional time limits are involved and other legal counsel has not yet been obtained;
e) if Respondent has not already done so, send written notification of the suspension of Respondent’s license by regular first class mail to the last known address found in Respondent’s files to each former client whose file may contain any of the following original executed documents: wills; other testamentary documents; unrecorded deeds; title insurance policies; abstracts of title; contracts; powers of attorney; stocks; and bonds. The notification shall inform the client that he or she may reclaim the file by requesting the same from the trustee within the designated time period;
f) give notice to other appropriate persons and entities, other than clients and former clients, who may be affected by the suspension of Respondent’s license;
g) arrange for the surrender or delivery of clients’ papers or property;
h) take possession and control as is necessary of any and all bank accounts and billing relating to Respondent’s law practice including the general or office account and the client trust account and return any unearned fees or unused amounts collected by Respondent for costs to the applicable clients;
i) do such other acts deemed appropriate by the trustee to protect the interest of Respondent’s clients; and
j) do such other acts as this Court may direct her to carry out.
