Probation was ordered terminated November 4, 2014

ORDER


Now at this day, the Court being sufficiently advised of and concerning the premises and having considered the statement of acceptance of the Disciplinary Hearing Panel filed by the parties and said cause having been briefed and argued;

The Court finds that Respondent, Tarak A. Devkota, Missouri Bar No. 51604, violated Rules 4-1.15(c) and 4-1.15(i) of the Rules of Professional Conduct by commingling personal funds and client funds in his trust account, using funds in the trust account directly to pay personal expenses, and having made no effort to promptly remove all personal funds from the trust account.

Respondent's prior disciplinary history includes and order of interim suspension issued in Supreme Court Case No. SC86499 and an order of suspension with the suspension stayed and Respondent placed on probation for a period of one year in Supreme Court Case No. SC87955;

Upon consideration of these findings, previous decisions of this Court, ABA Standards for Imposing Lawyer Discipline, and aggravating and mitigating circumstances, the Court suspends Respondent’s license with no leave to apply for reinstatement for a period of three years from the date of this order. The suspension is stayed and Respondent is placed on probation for three years from the date of this order in accordance with Rule 5.225 and under the terms agreed to by the parties and terms listed in the recommendation of the Disciplinary Hearing Panel filed in the cause on March 3, 2011.

Fee pursuant to Rule 5.19(h) in the amount of $1,000.00 payable to the Clerk of this Court to the credit of the Advisory Committee Fund taxed to Respondent.

Costs taxed to Respondent.
