Note: Mr. Posch was disbarred by the Court's order dated May 24, 2016.
ORDER
WHEREAS, the Chief Disciplinary Counsel filed an information and motion for final order of discipline pursuant to Rule 5.21(e) advising that Respondent pled guilty to the class C felony of endangering the welfare of a child in violation of §568.045 RSMo. in State v. Posch, Cape Girardeau County Circuit Court Case No. 14CG-CR00811-01.
The Court now being fully advised of and concerning the premises, does adjudge that probable cause exists that Respondent is guilty of professional misconduct and orders Respondent suspended from the practice of law on an interim basis. Said cause is referred to the chair of the Advisory Committee for further proceedings to be held under Rules 5.14 to 5.15 and a decision to be filed with the clerk of this Court. All filings shall be filed in this case number.
Now, therefore, it is ordered that Respondent, Kevin David Posch, be, and he is hereby suspended on an interim basis from the practice of law pending final resolution of this matter.
It is further ordered that Respondent, Kevin David Posch, comply in all respect with Rule 5.27 – Procedure Following a Disbarment or Suspension Order.
Costs taxed to Respondent.
