Rule 8. Facsimile Filings

The provisions of this rule are subject to Rule 103, Court Operating Rule 27 and Rule 18.

(a)    Routine motions, pleadings or correspondence which require only the original for filing will be accepted for filing by facsimile transmission if the document, together with any supporting documentation, does not constitute more than five pages.

(b)    Facsimile filings received at the Court before 4:00 p.m., of a regular work day, excluding holidays, will be deemed filed as of that day. Filings received after 4:00 p.m. will be deemed filed on the next regular Court work day. Time of receipt will be determined by the Court's facsimile machine.

(c)    Filings, other than routine motions, pleadings or correspondence, will not be accepted by facsimile transmission. Examples of documents which will not be accepted by facsimile include: records on appeal, briefs, writ petitions, transcripts, legal files, motions for rehearing, applications for transfer, suggestions in opposition to motions for rehearing or applications for transfer or to petitions for writs.

(d)    Any waiver of the provisions of this rule shall be ruled on by the Chief Judge or, in the Chief Judge's absence, by the Acting Chief Judge of the Court.

(e)    Other provisions for facsimile filings shall be in accordance with Supreme Court Rule 43.01.
