07. Domestic Relations Q&A


1. For Domestic cases are courts still required to redact those types of cases?
The court is responsible for redacting document filed prior to July 1, 2023. Section 509.520, RSMo, effective August 28, 2009, includes provisions for handling confidential information such as social security numbers. The court will be responsible for redacting documents that the court files.

2. What about domestic violence programs, drug programs and anger management programs?
Reports for the programs listed are at a default security level 3. Redaction is not necessary on documents because the case security is a 3.

3. Will we see the redacted and unredacted forms generated within Show-Me Courts prior to July 1st to make sure they are working or will that only get deployed on 7/1/2023?
Forms identified to have personally identifiable information are in SMC. Using SMC will generate a redacted and unredacted version of these forms.

4. When filing final judgment in a domestic case with a final parenting plan; form 14; separation agreement as an exhibit, are we supposed to raise the security level of the final parenting plan; form 14; and or separation agreement?

All of the documents listed above, if filed separately with the correct document code, will have the correct security level applied. The default security level for each document is a 3. However, if the information is included in the judgment, the court will need to file a redacted and unredacted judgment.
