12. Protection Orders Q&A


1. In protection order cases - I thought we were told the Petitions and Orders were automatically scanned in as a 3. However, when I looked at the ones we have done so far this year, they are actually scanned in at a level 1. Did I misunderstand or is there something we need to be doing? Adult Abuse/Stalking cases.
Orders of protection will not be available remotely. At this time, there are no changes to the process.

2. Will we need to redact the Full Orders of Protection? Will we need to file two separate documents?
The Order of Protection is treated differently in the system and on Case.net from all other case type because there is a federal law called the Violence Against Women Act that prohibits publication of victim information in domestic violence cases on the internet. Due to this law, the Order of Protection will be an exception for cases that are available for remote access. Currently, because of the confidential information that comes in on the petition. That petition is already a confidential document; however, Order of Protection is one of those unique cases in which the document security level in Case.net and in the Case Management System is different than what the statute says. If someone comes in and request a copy of the petition, it is public because the cases are public, but it may need review to ensure no personal identifying or confidential information is on the document. If there is confidential information it should not be release to the requestor.

3. Adult abuse forms have last four of SSN on them. Will this November 2022 form stay the same or be changed?

The State Judicial Records Committee approved changes to the forms related to Senate Bill 103. The changes were submitted to the Supreme Court for consideration.

4. If Adult Abuse/Child Abuse cases are not going to be available via remote public access, why would a redacted version of the ex parte, full order, or notice of hearing need to be issued?
The public is still entitled to the judgments and they are available on the public access terminal.

5. When a Full Order of Protection is entered, we will redact the Petitioner's name and minor children's names. Do we then have to redact the Ex Parte Order, Returns and Notices since the case is then viewable on the Public Terminal? FAQ are contradicting since it first says no change in process then the last answer is basically yes, redact.
If the order of protection is generated in Show-Me Courts, a redacted and unredacted version is generated.
