08. Juvenile Q&A


1. Do documents on juvenile cases need to redacted?
Juvenile cases are confidential and the documents contained in the case will not be visible remotely. The documents within the case are not required to be redacted.
 
2. Will attorneys know NOT to redact on juvenile cases since the case security is at a level 4?
The Missouri Bar has a website that provides information for attorneys.

3. Will Juvenile (capias) warrants be added to SMC by June 16? Currently the template (JO17) for these warrants is not in SMC so the juvenile clerk has to do them in JIS. Per the email that came out - Changes to Arrest Warrants effective June 16, warrant generation capability will be removed from JIS and can only be done in SMC. Please let us know which application we will need to do capias warrants come June 16.
The juvenile forms haven’t been updated and loaded into SMC at this time. We will have to do further consideration giving the changes with warrants, however since juvenile cases are confidential that information should not show up on Case.net. It would be a potential exception.

4. Are juvenile cases that are traffic citations going to be public record?
Yes.

5. When a minor, under 18, is issued a traffic citation does their name need to be replaced by initials or can it be left intact?

Section 509.520, RSMo does not apply to uniform citation traffic tickets; therefore, the minors name will not be replaced by initials.

6. How will minors be handled (every aspect).
Depends on the type of case.

7. Can you explain why and when a minors name is considered confidential information? The handout available on CIC states confidential information can include, but is not limited to: Names of individuals known to be minors. However, in the webinar during Q & A, the questions about minors names needing to be redacted in traffic case and minor guardianships and it was answered as "No, statute does not indicate that information as confidential. Therefore, my question is why would a minor's name be confidential in a dissolution or paternity action? I understand the full DOB and SSN being confidential but why the name in these cases?  How and when do we know for sure when the minor's name is confidential or not? Also, in the webinar during Q & A, it was stated that orders of protection would not be available remotely. Is the case security level being updated to a level 3 or 4? If not, what information is available to explain or show the public during questions as to why those cases are not available remotely but are opens.
Currently, there is a not a statute that would require the minor’s name be redacted but the changes in Senate Bill 103 may change that for civil cases.

8. Will pro se parties/parents in juvenile cases have access to their respective juvenile case(s)?
Self-represented litigants do not have electronic access to e-file at this time so they would not receive electronic filing access to documents. Court staff will have to provide paper copies of the requested documents to self-represented litigants.

1Previous answer: Traffic citation will have further analysis under Senate Bill 103. Currently, there are no statues that requires the minor’s names to be redacted from a traffic citation. Section 509.520, RSMo does not appear to be applicable to the uniform citation traffic tickets.
