09. Family Court Q&A


1. Upon filing, the documents are secured, but when the final Judgment is entered, these documents are included in the Judgment as exhibits, which the Judgment is now public record. Should the court separate the secured exhibits from the Judgment, keeping them at a level 3 or is the clerk going to have to redact in order to keep all documents together in the Judgment?
The judgment would need to filed as provided by the judge. The court may be able to file the exhibits with a higher security level.

2: How will this affect reports filed on behalf of a Court Appointed Special Advocate (CASA)?
Depending on the document security level that the document gets filed as, if they are filing it as a document that comes into the system as a security level 3 or above document redaction is not needed. If it’s a home study or other type of report, it’s already considered confidential; therefore, they will not have to redact. If it’s considered a public document, they would have to redact and file two versions of the document if it contains confidential information (redacted and unredacted) and the FI35 – Confidential Redacted Information Filing Sheet (CRIFS) form.
