2025 Legislative Update Materials
Legislation modifying section 57.280, RSMo, relating to the collection of civil service charges and mileage, takes effect August 28, 2025. Under the legislation, the sheriff's office responsible for service shall collect the charges, except for the special process server charge set out in section 57.280.5, RSMo which the circuit clerk shall collect. By August 28, OSCA will deploy accounting codes consistent with sheriffs collecting the civil service charges, and will remove codes where the clerk collects the civil service charges. Circuit clerks should contact the sheriff as soon as possible to determine whether the sheriff is able to start collecting the civil service charges Thursday, August 28.
  • If the sheriff IS able to collect the charges, there still may be local procedures to discuss.
  • If the sheriff is NOT able to collect the charges August 28, the circuit clerk and the sheriff may enter into a memorandum of understanding (MOU) for the clerk to continue collecting the charges until December 31, 2025. If OSCA receives a signed and compliant MOU by Tuesday, August 26, OSCA will keep the accounting codes in place for collection of the charges until December 31, 2025. This temporary process and temporary access to these accounting codes will end December 31. The December 31 date will not be extended. By December 31, clerks should be current on processing work associated with the charges. A template MOU has been emailed to all circuit clerks. For jurisdictions that need to enter into a MOU, the fully-executed, signed MOU on the OSCA template must be returned to OSCA at [email protected] by August 26.
