Rule 346. Redaction Requirements

(a) Responsibility. For all documents tendered for filing in this Court, the responsibility for redacting confidential information as required under Rule 84.015 rests solely with the counsel, party, or other person filing the document. This Court will not review documents to ensure all information that should be redacted is redacted.

(b) Certification. Pursuant to Rule 84.015, all documents tendered for filing in this Court, except in any appeal that is sealed or confidential pursuant to statute, must include a certification that the filer has complied with the redaction requirements of the rule. These documents include, but are not limited to, motions, non-system generated legal files, transcripts, briefs, appendices, and writ filings.

(c) Filing Sheet. If redacted documents are filed with this Court, the filer shall simultaneously file an unredacted version of the documents along with the confidential redacted information filing sheet.

(d) Rejected Filings. Any document filed in this Court without the necessary certification of redaction required under section Rule 84.015 may be rejected and returned to the filer by the clerk.

(e) Writs. Any filer in a writ proceeding offering multiple documents, including a petition, suggestions in support, and exhibits, may provide one certification for all of the documents under subsection (b). When filing any unredacted version of writ documents, the filer must include a separate filing sheet for each unredacted document and each unredacted document must be filed separately.

(f) Court as Filer. Under Rule 2.02, this Court will not certify compliance with the redaction requirements when filing its own documents.

(g) System-Generated Legal Files.  In addition to the requirements of Supreme Court Rule 81.12(b)(1), when designating documents for inclusion in a system-generated legal file or system-generated supplemental legal file, the parties should designate only unredacted versions of documents whenever possible.  If a redacted document was filed with a confidential redacted information filing sheet (CRIFS) only and no unredacted version is available for designation, parties should designate the redacted document and the CRIFS.
