Rule 395. Oral Argument

(a) The maximum time for oral argument in a case screened regular or a writ proceeding shall be fifteen minutes for appellant or relator, fifteen minutes for respondent and three minutes for appellant or relator to reply. Time may be extended or shortened by the presiding judge.

(b) The maximum time for oral argument in a case screened accelerated shall be ten minutes for appellant, ten minutes for respondent and two minutes for appellant to reply. Time may be extended or shortened by the presiding judge.

(c) Consolidated cross appeals shall be treated at oral argument as one appeal and the plaintiff in the trial court shall open and close the argument, unless otherwise directed by the presiding judge.

(d) If there are multiple appellants or respondents, they shall divide the time allotted for the appellant or respondent respectively.

(e) A motion requesting additional time for argument must be filed not later than five days before the case is to be heard. The motion will be referred to the presiding judge of the division to which the case is assigned.

(f) A respondent who has not filed a brief shall not be permitted to orally argue the respondent’s case.
